DEFINITIONS
Subscriber:
Refers to the individual or entity who has subscribed to the data eSIM service and is using it according to the terms and conditions outlined in this policy.
Service:
Refers to the data eSIM service provided by BNESIM, which includes access to data, internet connectivity, and any associated features as part of the subscription.
Service Provider:
Refers to BNESIM Limited, the company providing the data eSIM service.
POLICY OVERVIEW
Subscriber’s use of the Service is subject to the following rules and guidelines contained in this policy. This policy is designed to ensure that Subscriber’s use of the Service does not break any law, hinder the efficient operation of Service Provider’s network, or interfere with the rights of other subscribers and internet users.
Subscriber is responsible for ensuring that their use of the Service and internet account (if any) complies with this policy. They are also responsible for any use of the Service by any person who gains access to the Service or the Subscriber’s account — whether with or without the Subscriber’s knowledge or consent.
If the Subscriber becomes aware of any violations of this policy by others, they should contact BNESIM using available customer support channels, such as email at [email protected].
FAIR USE POLICY FOR DATA eSIM SERVICE
The data eSIM service is intended for personal use only and is subject to this Fair Use Policy. We reserve the right to terminate or suspend any subscription that violates this policy.
This policy helps prevent network abuse, allowing us to optimize network capacity and maintain the quality of our services for all customers. While most users will not be affected, if we detect patterns of usage that negatively impact the quality of service for others, we reserve the right to take reasonable actions, including applying speed limits, usage caps, or temporary service restrictions.
These measures are taken to prevent abuse and ensure fair use of the network.
ILLEGAL OR PROHIBITED ACTIVITIES
The use of the data eSIM for IPTV, continuous downloading, and excessive audio/video streaming is prohibited in order to avoid saturating resources for all users. Streaming short videos on social networks is not restricted.
Subscriber agrees to use the Service only for lawful and permitted purposes. Prohibited activities include (but are not limited to):
(i) Any activity constituting a cybercrime offense under applicable law;
(ii) The following specific activities:
- (a) Gaining unauthorized access to any computer, system, or network, including probing, scanning, or testing the vulnerability of a system or network;
- (b) Using or distributing tools designed to compromise security, such as password crackers, packet sniffers, or network probing software;
- (c) Transmitting or disseminating viruses, worms, or other harmful software;
- (d) Using the Service to interfere with or disrupt the operation of networks or services, including denial-of-service attacks, network flooding, or system overloading;
- (e) Attempting to interfere with the normal functioning of BNESIM’s infrastructure or services.
(iii) Accessing, posting, reproducing, or disseminating content that violates laws or regulations, including but not limited to:
- (a) Content with excessive violence, sexual material, or instructions for criminal activity;
- (b) Child pornography, bestiality, or any other illegal depictions of sexual or criminal conduct;
- (c) Content that infringes on intellectual property rights or defames, harasses, or abuses any individual or group;
- (d) Fraudulent schemes, including pyramid schemes or unlawful solicitations;
- (e) Any activity involving bypassing or reselling the Service in breach of applicable law.
SECURITY
Subscriber is responsible for maintaining the confidentiality and security of their login credentials, access codes, and any personal devices used to access the Service. BNESIM recommends enabling device-level security measures (e.g., passcodes, biometric locks) and not sharing credentials with others.
Subscriber agrees and acknowledges that any transmission made through the Service originating from their account shall be conclusively presumed to be authorized by the Subscriber. It is the Subscriber’s responsibility to obtain any required consent from recipients for communications made using the Service.
For security purposes, BNESIM advises against enabling file sharing or remote access services without adequate safeguards such as passwords or other protective measures. Subscribers must immediately notify BNESIM of any unauthorized or attempted unauthorized use of the Service or any other security breaches.
SOFTWARE APPLICATION
Subscriber acknowledges and agrees to the following terms when using the software application provided by BNESIM (the Kaspersky eSIM Store mobile app, referred to as the “Application”):
(a) The Application must be used properly and only on the device intended for the Subscriber’s personal use, without modification, tampering, or reconfiguration, in accordance with any applicable software license or user guide;
(b) The Application must not be installed on any other device, personal computer, or networked storage system unless explicitly permitted by a license agreement;
(c) The Application must not be resold, transferred, rented, leased, or lent to any third party without BNESIM’s prior written consent;
(d) The Application must not be reverse engineered, decompiled, or disassembled.
Subscriber agrees to promptly report any issues or damage to the Application and any circumstances or actions by third parties that may pose a risk to the Service.
RISKS OF THE INTERNET
Certain activities performed while accessing the internet carry inherent risks and may result in harm or loss to the Subscriber or others. These activities include, but are not limited to:
(i) Downloading content (including emails) that may contain viruses, malware, or other harmful elements;
(ii) Purchasing goods or services online from unverified sources;
(iii) Transmitting confidential information over the internet (e.g., credit card numbers, personal data);
(iv) Accessing or viewing content that may be inappropriate or offensive, including material unsuitable for children.
The Subscriber assumes all risks associated with these activities. BNESIM shall not be liable for any loss, damage, or legal consequence resulting from such use. To help mitigate these risks, Subscribers may choose to use content filtering or parental control solutions.
