Terms and Conditions of the Kaspersky eSIM Store Referral Program

Program Organizer: BNESIM Limited, Unit C, 8/F, King Palace Plaza, No. 55 King Yip Street, Kwun Tong, Kowloon, Hong Kong, email: kasperskyesimstore@bnesim.com.

These Terms and Conditions apply to all current and future accounts in the Kaspersky eSIM Store application (the “Application”).

Definitions. The terms used herein have the following meanings solely within this document:

• Calendar Year: January 1 to December 31, during which Referral rewards are capped.
• Discount (Referral Discount): A cost reduction (3 euro or equivalent) applied to a Referred User's first eSIM purchase using a Referral Code.
• Exchange Rate: The official rate (as displayed in the Application) between the payment currency and euros on the transaction date.
• Kaspersky eSIM Store (Application): A mobile application for registering, purchasing, and managing eSIM plans and K-coins, and participating in the referral program.
• New User: A person without prior Application purchases or Referral Program participation via any account.
• Organizer: BNESIM Limited, responsible for administering the Referral Program.
• Paid K-coins: K-coins purchased with fiat currency (1 Paid K-coin = 1 Referral Point), redeemable for eSIM plans.
• Personal Data: Information provided during Application use or Referral Program participation, processed per the Privacy Policy.
• Point Validity Period: One year from crediting, after which Referral Points expire.
• Program Abuse: Actions circumventing these Terms, such as creating multiple accounts for rewards or Discounts.
• Promotion: A time-limited event offering enhanced Discounts, Referral Points, or benefits under these Terms.
• Referral Program: A promotion allowing registered Application users to earn rewards by inviting new users via unique referral codes.
• Referral Points (K-coins): Non-monetary units earned by the referring user when referred users meet program requirements. K-coins may also be purchased (as “Paid K-coins”) and are redeemable for eSIM plans in the Application.
• Referring User: An existing Application user eligible to invite new users via a unique referral code and earn Referral Points.
• Referred User: A new Application user who has not previously participated in the Referral Program or purchased eSIMs, and who applies the Referring User's referral code to their first purchase.
• Referral Code: A unique alphanumeric sequence generated in the Application's Referral Program section for sharing with new users.
• Rewards: Referral Points awarded to Referring Users when Referred Users complete required actions (e.g., first purchase of specified value).
• User Account: A personal registration entry in the Application used for login, purchases, and Referral Program participation.
• Technical Error: System faults leading to incorrect K-coin crediting, correctable by the Organizer.
• Tax Residence: The User's jurisdiction for fulfilling tax obligations from program rewards.

The Referral Program enables registered Application users to earn K-coins for inviting others, redeemable for eSIM purchases.

1. Eligibility

1.1. Participation is limited to individuals aged 18 or older who provide accurate information, including age verification. False information results in disqualification.

1.2. Referring User. Must hold a User Account and complete purchases totaling at least 5 euros (or equivalent per Exchange Rate) prior to generating Referral Codes.

1.3. Referred User. Must be a New User who applies a valid Referral Code to their first purchase.

2. Referral Process

2.1. Referring Users generate a unique Referral Code in the Application's Referral Program section.

2.2. Referring Users may share Referral Codes with potential Referred Users using only legal and ethical means (no spam, fraud, or incentives violating laws).

2.3. Referred Users must enter the Referral Code at first purchase of the eSIM checkout.

2.4. Upon Referred User's purchase, the Referring User receives 3 Referral Points, viewable in the Referral Program section.

2.5. Referring Users must safeguard their Referral Code; the Organizer bears no liability in the event the Referral Code being used by any unauthorized third party.

3. Referred User Discount

3.1. Referred Users have to enter the Referral Code during their first eSIM purchase (the purchase must be minimum 6 euros or equivalent per Exchange Rate).

3.2. A 3-euro (or equivalent) Discount applies only to the first qualifying purchase and is forfeited on cancellation/refund.

3.3. Discounts cannot combine with other offers or Promotions.

4. Referring User Rewards

4.1. Referring User will get rewarded (3 Referral Points) within 24 hours after Referred User's purchase.

4.2. Rewards void if the purchase cancels/refunds.

4.3. Notifications to Referring User appear in the Application; suspected Program Abuse allows temporary locking or nullification of Points.

4.4. Referral Points are redeemable solely for eSIM data plan purchases (1 Point = 1 euro or equivalent per Exchange Rate).

4.6. Referral Points are non-transferable, non-exchangeable for cash, and non-inheritable.

4.7. Referral Points and Paid K-coins are deducted depending on expiration date. Those that expire earlier, are deducted first.

4.8. Referral Points expire one year after receipt of such Referral Points; balances are viewable in the Application.

4.9. Technical Errors permit Organizer's correcting balances of Referral Points with notice to Referring User.

5. Paid K-coins

5.1. Users may purchase Paid K-coins (1 Paid K-coin = 1 euro or equivalent) to supplement Referral Points balances.

5.2. Paid K-coins credit immediately, equate to Referral Points and can be refunded through request to support.

6. Cancellations and Refunds

6.1. The Organizer may cancel orders, void K-coins, or disqualify Users for:

• Fraudulent activity;
• Program Abuse (e.g., multi-accounts);

6.2. Paid K-coins are refunded at Exchange Rate (1 Paid K-coin = 1 euro equivalent).

6.3. Program Abuse triggers security review and potential blocking of the User Account.

7. General Provisions

7.1. Participation in Kaspersky eSIM Store Referral Program constitutes acceptance of these Terms.

7.2. The Organizer may amend, suspend, or terminate the Program with in-app notice; users monitor updates.

7.3. Organizer decisions on eligibility, interpretation, or disputes are final, subject to appeal in courts at the place of ordinary residence of User.

7.4. Users bear internet/access costs.

7.5. Users handle taxes per their Tax Residence.

7.6. Governed by English Law subject to mandatory provisions of law at the place of residence of User; English version prevails.

7.7. Invalid provisions do not affect others.

7.8. Organizer disclaims all liability in the event User fails to comply with these Terms.

7.9. Complaints may be addressed via kasperskyesimstore@bnesim.com (response within 30 days).
